There was a motion to accept the minutes of the August 15th meeting with 1 correction.  The    motion was seconded and accepted with a vote of 4-0-0.

Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Minor Buffer Zone Activity:  680 Pleasant Street
Ms. Jessie Fanuele and Mr. Vincent Fanuele, the applicants, both appeared before the Commission for the construction of a concrete patio and fence.  The patio is 15’x30’ in size.   

Michele Grenier stated that she has contacted the DEP and determined that decks and porches are now exempt under the Rivers Protection Act and this project should be handled under a Minor Buffer Zone Activity filing.

There was a motion to accept the Minor Buffer Zone Application for 680 Pleasant Street with the 3 additional conditions that all of the excess excavation must be removed, pitch the grade away from the house and any newly graded areas must be seeded and vegetated.  The motion was seconded and accepted with a vote of 4-0-0.

Minor Buffer Zone Activity:  27 Josephine Street – Milliken Avenue Pump Station
Mr. Deacon Perrotta, Director of Operations for the DPW, and Ms. Laurie Ruzula, the Water & Sewer Superintendent, both appeared before the Commission for the installation of a grinder at the Milliken Avenue pump station.  The top portion of the manhole will be removed and rails will be installed and the grinder is placed on the rails for maintenance purposes.  A hatch will be installed for access for maintenance purposes.  The site is surrounded with uplands with wetlands located more than 80 ft. away from the location of the work.

There was a motion to approve the muffin monster project for the sewer department with the 3 standard conditions.  The motion was seconded and accepted with a vote of 4-0-0.

Continued - Public Hearing - Notice of Intent – Lot 14-1 & 1B Lena Circle – Marquerite - CE159-1051
Mr. Rob Truax, Engineer of GLM Engineering, and Dennis Marguerite, the applicant and property owner, both appeared before the Commission for the construction of a single-family house.  Mr. Truax submitted revised plans and provided the Commission members with an overview of these plans.

Mr. Truax stated that these plans depict all of the work being undertaken on the lot.  The plans do not depict a stockpile area but it could be placed outside of the 100 ft. buffer zone to the rear of the lot in the rear corner.

There was a motion to approve the amended plan with the special condition that the stockpile be stored north of the site outside of the 100 ft. buffer zone and the 3 standard conditions; the work must be done according to the plan, that the Conservation Dept. be notified when the work starts and the Conservation Dept. be notified with the work has been completed.  The motion was seconded and accepted with a vote of 4-0-0.

Certificate of Compliance:  Honey Dew Donuts – CE159-965
Michele Grenier informed the Commission that she has visited the site and the work has been built according to the plan and there is a rain garden installed.  The Japanese Knotwood has been removed which was requested by the Commission in the original filing.

Ms. Grenier will check to determine if the dumpster is in the correct location and according to the plan.

There was a motion to issue the Certificate of Compliance for Honey Dew Donuts, 365 West Central Street with the condition that the Agent will conduct an inspection to determine if the dumpster is located in the correct place.  The motion was seconded and accepted with a vote of 4-0-0.

Certificate of Compliance:  MBCR Culvert Replacement - CE159-1033
Michele Grenier informed the Commission that she has visited the MBCR culvert and it has all been completely revegetated and recommended the issuance of a Certificate of Compliance.

There was a motion to issue a Certificate of Compliance for the MBCR Culvert Replacement.  The motion was seconded and accepted with a vote of 4-0-0.

Discussion:  656 King Street
Ms. Debbie Murphy of 17 Forest Street, an abutter to the Emeritus project at 656 King Street, appeared before the Commission to state her concerns regarding the effect the work is having on her backyard.  

She submitted some photos of her yard and the condition of the silt barriers.  She requested a copy of the inspection from the consultant inspecting the site on behalf of the Commission.

She provided the Commission with an update of what is transpiring with the site with representatives from the town as well as from the Wegman Companies.

Michele Grenier stated that Mike Maglio, Town Engineer, Gus Brown, Building Commissioner, and herself visited the site and walked the erosion control barriers and found that haybales need to be added to the end of the road.  Silt socks cannot be used on this site; you must use strawbales and silt fences as construction sites have a lot of loose sediment until the site has been  paved.

Michele Grenier stated that in the future Ms. Karon Catrone Skinner will be conducting the inspections and will make sure that all of the sedimentation is done correctly.  A Commission member stated that an inspection must be conducted after a rain event and the Conservation Commission should receive a copy of this report.

Ms. Murphy questioned if the inspections are being done according to the specifications of Special Condition #31 in the Orders of Conditions.  Ms. Grenier will look into this matter and check the Conservation file and report back to the Commission.

Ms. Grenier stated that she will send a letter to the Wegman Companies and reiterate the special conditions in the Orders of Conditions to them to ensure that they are complied with.

A Commission member stated that the inspections must be done weekly and after a storm event and understate that all of the subcontractors working on this job is aware that there is no staging in this location as this is what is disturbing the berm.

There was a motion to adjourn the meeting.  The motion was seconded and accepted with a vote of 4-0-0.
